02 · Poland

Confirmation, not a grant

Poland recognizes citizenship by descent with no generational limit — great-grandparent lines can work if citizenship passed unbroken at each birth.

The operative date is 31 January 1920: your ancestor (or their line) must have held Polish citizenship on or after that date under the 1920 Citizenship Act.

From 1920 to 19 January 1951, citizenship passed through the father for children born in wedlock, and through the mother for children born out of wedlock.

Lines break through foreign naturalization, foreign military service, or foreign public office before 1951 — but the "military paradox" saved many men who naturalized abroad while still liable for Polish military service.

03 · Germany

Parent at birth, then the repair routes

German citizenship by descent turns on your birth date and which parent was German: before 1 January 1975 (in wedlock), only the father transmitted; from 1975, either parent does (StAG § 4).

Out of wedlock: a German mother always transmitted; a German father transmits from 1 July 1993 (with paternity established).

If gender-discriminatory rules cut you (or a parent/grandparent) out, the § 5 declaration right (2021 amendment) can restore the line — free of charge, but the window closes 19 August 2031.

Descendants of people stripped of citizenship by the Nazi regime (1933–1945) have a constitutional restoration route: Art. 116(2) GG, supplemented by StAG § 15.

Since 27 June 2024 (StARModG), Germany generally permits dual citizenship — you no longer have to give up your existing passport.

Common questions

Which is easier, Polish or German citizenship by descent?

There is no honest single answer. Poland has no generational limit but every link must survive 1920–1951 loss rules. Germany usually needs a German parent at each birth, with repair routes (§ 5 until 19 August 2031; Art. 116(2) / § 15 for Nazi-era deprivation). The cheaper official stamp is Poland’s PLN 277 confirmation fee; Germany’s § 5 declaration is recorded as free of charge (verifying). Neither page checks your file.

Can I claim through a great-grandparent?

Poland: in principle yes if citizenship passed unbroken from an ancestor who held Polish citizenship on or after 31 January 1920. Germany: only if each intervening birth transmitted under StAG § 4, or a documented repair (declaration or restitution) applies. There is no general German great-grandparent shortcut.

Do I have to give up my current passport?

Poland’s confirmation procedure does not require renunciation; whether your other state allows dual nationality is that state’s law.
